The educational materials developed by The Link School represent a significant investment of intellectual and creative effort by our faculty and curriculum designers. These materials — which include but are not limited to the foundational curriculum frameworks for both the Inquiry Track and Mastery Track, the integrated thematic units that cross traditional subject boundaries, the proprietary assessment rubrics and competency matrices, the digital learning modules housed within our learning management system, and the instructional guides and teacher resources that support classroom delivery — are protected as trade secrets and copyrighted works. You may view, download, and print portions of the materials from the Services for your personal, non-commercial, educational use only, provided that you maintain all copyright and other proprietary notices contained therein. 9. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall The Link School, its officers, directors, employees, agents, licensors, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses — even if The Link School has been advised of the possibility of such damages — arising out of or in connection with your use of, or inability to use, the Services, including but not limited to any damages resulting from: your reliance on any information or content obtained through the Services; mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation or transmission, or any failure of performance; the cost of procurement of substitute goods or services resulting from any goods, data, information, or services obtained through the Services; unauthorized access to or alteration of your transmissions or data; statements or conduct of any third party on the Services; or any other matter relating to the Services.
The total cumulative liability of The Link School, its officers, directors, employees, agents, licensors, and suppliers to any user of the Services for any and all claims arising out of or relating to these Terms or the use of the Services shall not exceed the greater of: the amount paid by you, if any, to The Link School for the specific Service giving rise to the claim during the twelve-month period preceding the event giving rise to the claim; or one hundred United States dollars. 10. Indemnification
You agree to defend, indemnify, and hold harmless The Link School, its officers, directors, employees, agents, licensors, suppliers, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses — including but not limited to reasonable attorney’s fees and court costs — arising from or related to: your use of and access to the Services, including any data, content, or materials transmitted or received by you; your violation of any term of these Terms, including without limitation your breach of any of the representations and warranties set forth herein; your violation of any third-party right, including without limitation any intellectual property right, publicity right, confidentiality right, property right, or privacy right; your violation of any applicable law, rule, or regulation; any User Content that you submit, post, transmit, or make available through the Services; or any other party’s access and use of the Services with your account credentials or unique username and password, whether or not such access and use was authorized by you.
In the educational context, the obligation to indemnify carries particular weight because the actions of a single user — for example, a student who shares copyrighted third-party materials through our learning management system without permission, or a parent who posts defamatory content in a school discussion forum — can create legal exposure not only for the individual user but also for the institution as a whole. The Link School depends on every member of our learning community to act responsibly and to respect the legal rights of others, both within and beyond our digital ecosystem. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case you agree to cooperate with our defense of such claim. You shall not, in any event, settle any matter subject to indemnification without the prior written consent of The Link School. This indemnification obligation shall survive the termination or expiration of these Terms and your cessation of use of the Services.
11. Termination
The Link School reserves the right, in its sole discretion and without prior notice, to terminate or suspend your access to all or any portion of the Services at any time and for any reason, including but not limited to: your violation or breach of any provision of these Terms; your engagement in conduct that The Link School, in its sole judgment, deems to be harmful to other users, to the integrity of the school community, or to the reputation or interests of The Link School; your failure to pay any fees or tuition associated with Services requiring payment, where applicable; a request by law enforcement or other government agency; the discontinuance or material modification of the Services or any part thereof; unexpected technical or security issues or problems; or extended periods of inactivity on your account. Upon termination, your right to use the Services will immediately cease, and you must promptly destroy all materials downloaded or otherwise obtained from the Services, as well as all copies of such materials, whether made under these Terms or otherwise.
Termination of your access to the Services does not extinguish all obligations under these Terms. The provisions of these Terms that by their nature should survive termination — including but not limited to the provisions concerning intellectual property rights, user-generated content licenses, disclaimers of warranties, limitations of liability, indemnification, governing law and dispute resolution, and the miscellaneous provisions set forth at the conclusion of these Terms — shall continue in full force and effect after any termination. For students and families whose relationship with The Link School extends beyond digital services to include in-person enrollment and instruction, termination of digital service access does not necessarily terminate the broader educational relationship, which is governed by separate enrollment agreements, tuition contracts, and school policies. The Link School will make reasonable efforts to provide notice of termination through the contact information associated with your account, but we shall not be liable for any failure to provide such notice where circumstances make it impracticable to do so. You may terminate your account at any time by ceasing all use of the Services and notifying The Link School of your desire to close your account through the contact information provided in these Terms.
12. Governing Law and Dispute Resolution
These Terms and any dispute or claim arising out of or in connection with them — including non-contractual disputes or claims — shall be governed by and construed in accordance with the laws of the State of Colorado, United States of America, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to these Terms or any transactions conducted through the Services. By using the Services, you agree that any legal action, suit, or proceeding arising out of or relating to these Terms or your use of the Services shall be instituted exclusively in the federal or state courts located in Chaffee County, Colorado, and you irrevocably consent to the personal jurisdiction of such courts and waive any objection based on improper venue or forum non conveniens. You agree that any claim or cause of action arising out of or related to these Terms or the use of the Services must be filed within one year after such claim or cause of action arose, or it shall be forever barred, notwithstanding any statute of limitations or other law to the contrary.

This informal resolution requirement reflects The Link School’s commitment to resolving disagreements through dialogue and mutual understanding — values that are central to our educational philosophy. The arbitration shall take place in Chaffee County, Colorado, before a single arbitrator with experience in matters relating to educational institutions and technology law. The arbitrator shall have the authority to award the same damages and relief that a court of competent jurisdiction could award, consistent with the limitation of liability provisions set forth in these Terms. Each party shall bear its own costs and attorney’s fees in connection with any arbitration proceeding, unless the arbitrator determines that the claims or defenses of one party were frivolous or brought in bad faith, in which case the arbitrator may award reasonable fees and costs to the prevailing party.
13. Changes to These Terms
The Link School reserves the right, at its sole discretion, to modify, update, or replace these Terms of Service at any time. The most current version of these Terms will always be available on this page at linkschool.rest/terms-of-service, and the Last updated date at the top of the document will indicate when the most recent changes took effect. You further agree to instruct your child regarding the importance of protecting their account credentials and not sharing passwords with anyone, including friends and classmates.
The Link School views parents and guardians as essential partners in the educational process, and the digital dimension of that partnership requires proactive engagement.
